Terms of Service

Last updated: [PENDING LEGAL REVIEW]

Draft — pending legal review

This is a starting template, not legal advice. It must be reviewed and finalized by a qualified attorney before Go Stats relies on it. Highlighted items like [THIS] are placeholders that need a business or legal decision.

These Terms of Service (the "Terms") are a binding agreement between you and [COMPANY LEGAL NAME, INC.] ("Go Stats," "we," "us," or "our") and govern your access to and use of the Go Stats websites, mobile apps, developer API, and related services (together, the "Service"). Please read them carefully.

1Agreement to These Terms

By creating an account, checking the "I agree" box, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a league, team, school, organization, or other entity, you represent that you are authorized to bind that entity, and "you" refers to that entity.

2Eligibility & Minors

You must be at least 13 years old to create your own Go Stats account. The Service is not directed to children under 13, and we do not knowingly allow children under 13 to create accounts or knowingly collect personal information from them. If you believe a child under 13 has provided us personal information, contact us and we will take appropriate steps to delete it.

If you are between 13 and 18 (or the age of majority where you live), you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

Youth athletes. Leagues, teams, coaches, and parents may create and manage profiles, rosters, and statistics that reference minors. If you submit information about a minor, you represent that you have the authority and any necessary parental or guardian consent to do so. How we handle children's data is described in our Privacy Policy and is subject to applicable laws such as the U.S. Children's Online Privacy Protection Act (COPPA). See also Section 7 (Player Profiles).

3Your Account

You are responsible for the information you provide and for all activity under your account. You agree to:

  • Provide accurate, current, and complete information and keep it up to date;
  • Keep your password and credentials confidential and not share your account;
  • Be responsible for all activity that occurs under your account; and
  • Notify us promptly of any unauthorized use or suspected security breach.

We may refuse, suspend, or reclaim any username, and we may suspend or close accounts as described in Section 16.

4The Service

Go Stats provides multi-sport statistics and live game tracking for leagues, teams, and players across basketball, football, soccer, 7-on-7, and other sports we may add, including public league, team, and player pages; consumer browsing and "follow" features; mobile apps; and a developer API (Section 9).

We are continually improving the Service and may add, change, suspend, or remove features at any time. We may also set limits on usage or storage. We will use reasonable efforts to notify you of material changes that significantly reduce core functionality.

5Plans, Billing & Refunds

Some features are free; others require a paid subscription. Pricing and plan details are shown at checkout and on our pricing page. By subscribing, you authorize us and our payment processor ([Stripe / PROCESSOR]) to charge your payment method for the fees and applicable taxes.

  • Auto-renewal. Paid plans renew automatically each billing period until cancelled. You can cancel anytime; cancellation takes effect at the end of the current period.
  • Price changes. We may change fees, but we will give you advance notice of [30] days before a change applies to your renewal.
  • Refunds. Except where required by law, fees are [non-refundable / refundable within X days]. Our refund policy is [DESCRIBE].
  • Non-payment. If a charge fails, we may suspend or downgrade paid features until payment is resolved.

6Your Content & License to Us

"Your Content" means the data and materials you submit to the Service — including rosters, schedules, statistics, scores, team and player names, logos, photos, and media. As between you and Go Stats, you retain ownership of Your Content.

You grant Go Stats a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and create derivative works of Your Content as needed to operate, improve, and promote the Service — including showing it on public pages and through the API. This license ends when Your Content is deleted, except for content others have shared or that we must retain to comply with law or for backups.

You represent that you have the rights to submit Your Content and that it does not violate these Terms or any third party's rights. We may remove content that we believe violates these Terms or applicable law.

7Player Profiles, Names & Likeness

The Service creates public profiles and pages that may display names, statistics, photos, and other information about players, including amateur and youth athletes. By submitting this information, you represent you have the right to do so.

  • Athletes (or their parents/guardians for minors) may request to claim, correct, or remove a profile through our designated process.
  • We will provide a way to dispute or take down inaccurate or improperly posted information. Our process and timelines are described at [LINK / EMAIL].
  • Use of athlete names, images, and likeness is intended for legitimate statistics and coverage of the games they participate in, and is subject to applicable name-image-likeness (NIL), privacy, and publicity laws.

8Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law;
  • Post content that is infringing, defamatory, harassing, hateful, or invasive of privacy;
  • Submit false, manipulated, or misleading scores, statistics, or identities;
  • Impersonate any person or entity or misrepresent your affiliation;
  • Scrape, harvest, or bulk-download data except as expressly permitted via the API and within its limits;
  • Reverse engineer, decompile, or attempt to access the source code of the Service;
  • Probe, scan, or circumvent security, rate limits, or access controls; or
  • Interfere with or disrupt the integrity or performance of the Service.

9Developer API

If you access the developer API, you must register for API credentials, keep them confidential, and comply with these Terms and any published API documentation, rate limits, and usage policies.

  • You are responsible for all activity under your API keys; do not share or expose them.
  • Do not exceed rate limits, resell raw API data, or build a competing dataset by scraping the API, except as expressly permitted.
  • Provide reasonable attribution to Go Stats where required by the documentation.
  • We may modify, rate-limit, deprecate, or revoke API access at any time, including to protect the Service or its users.

10Our Intellectual Property

The Service, including our software, design, text, graphics, and the "Go Stats" name and logos, is owned by Go Stats or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction or obligation to you.

11Third-Party Services

The Service may link to or integrate with third-party websites and services that we do not control. We are not responsible for their content, policies, or practices, and your use of them is governed by their own terms.

12Privacy

Our Privacy Policy explains how we collect, use, and share personal information, including information about minors. By using the Service, you acknowledge the practices described there. The Privacy Policy is incorporated into these Terms by reference.

13Disclaimers

THE SERVICE AND ALL STATISTICS, SCORES, AND DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any statistics or data are accurate, complete, or current. Stats are often entered by leagues, teams, and other users and may contain errors.

14Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO STATS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF [THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM] OR [USD 100]. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15Indemnification

You agree to indemnify and hold harmless Go Stats and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or any law or third-party right.

16Suspension & Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Upon termination, your right to use the Service ends. Sections that by their nature should survive — including content licenses already granted, disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.

17Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms with a new "Last updated" date or by notifying you in-product or by email). Your continued use of the Service after the changes take effect means you accept the updated Terms.

18Governing Law & Dispute Resolution

These Terms are governed by the laws of [STATE/COUNTRY], without regard to its conflict-of-laws rules.

Informal resolution first. Before filing a claim, you agree to try to resolve the dispute informally by contacting us; we'll try to do the same.

[ARBITRATION / CLASS-ACTION WAIVER — counsel to decide whether to require binding arbitration through a provider such as AAA/JAMS, the seat and rules, a class-action waiver, a small-claims carve-out, and any opt-out right. These provisions have specific drafting and enforceability requirements and must be reviewed by an attorney.]
